Terms and Conditions (T&Cs)

These Terms and Conditions apply to all orders placed via clubeboss.shop, operated by Clube Boss. Contact: support@clubeboss.com · Phone/WhatsApp: +44 161 391 0528.

1. Scope of Application

These General Terms and Conditions (T&Cs) apply to all contracts concluded between Clube Boss and consumers or entrepreneurs via the online shop clubeboss.shop. Any deviating conditions from the customer will not be recognized unless Clube Boss expressly agrees to their validity in writing.

2. Contractual Partner and Contact

3. Offers, Product Presentation, and Conclusion of Contract

The presentation of products in the online shop does not constitute a legally binding offer, but rather an invitation to place an order. By completing the checkout process, you submit a binding offer. The contract is concluded when we accept your order by sending an order confirmation via email or by shipping the goods. Automated order receipts do not yet constitute acceptance.

Technical and design deviations (e.g., slight color differences due to screen settings) remain reserved within a reasonable scope.

4. Prices, VAT, and Shipping Costs

All prices are in Euro and include the applicable statutory VAT. Any shipping costs will be clearly displayed in the checkout before the order is completed. Promotional prices and discounts are temporary and cannot be combined unless otherwise stated.

5. Payment Terms

The available payment methods (e.g., Shopify Payments, Credit Card, PayPal) are displayed at checkout. Payment is due upon conclusion of the contract. In the event of chargebacks or failed payments, we reserve the right to claim any incurred costs.

6. Delivery, Shipping Times, and Availability

Deliveries are made within Germany. The standard delivery time is 5–12 business days after shipping confirmation. A processing time of 1–2 business days is to be expected before shipping. Partial deliveries are permitted, provided they are reasonable for you and do not incur additional shipping costs.

If a product is permanently unavailable, we will decline acceptance of the order; in this case, no contract is concluded. We will inform you of any temporary delivery delays via email.

7. Retention of Title

The goods remain our property until full payment has been made.

8. Right of Withdrawal for Consumers

Consumers have a legal right to withdraw from the contract within 14 days of receiving the goods. Details, deadlines, exceptions, and the model withdrawal form can be found in our Cancellation Policy. Additional regulations are described in the Return & Refund Policy.

9. Returns

Please register returns in advance with customer service and follow the return instructions sent via email. Unless otherwise required by law, customers bear the direct costs of returning the goods. Further details can be found in the Return & Refund Policy.

10. Statutory Warranty

Statutory warranty rights apply. In the case of obvious transport damage, we ask that you report it to the carrier if possible and inform us immediately to facilitate any claims against the transporter. Failure to do so does not affect your legal rights.

11. Liability

We are liable without limitation for intent and gross negligence, as well as for damages resulting from injury to life, body, or health. In the event of a slightly negligent breach of essential contractual obligations, our liability is limited to the amount of typical, foreseeable damage. Otherwise, liability is excluded. Mandatory legal liability remains unaffected.

12. Vouchers, Promotions, and Gift Cards

Vouchers and discount codes are for one-time use and only redeemable during the specified period, unless otherwise stated. Cash payouts are excluded. Gift cards can be used for goods offered in the shop; any remaining balance stays on the card.

13. Customer Account

Creating a customer account is optional. Access data must be treated confidentially. Clube Boss reserves the right to block accounts in case of misuse.

Information on the processing of personal data, cookies, analysis tools, and marketing services can be found in our Privacy Policy.

15. Dispute Resolution, EU Platform

The European Commission provides a platform for online dispute resolution (ODR): https://ec.europa.eu/consumers/odr. We are not obliged and generally not willing to participate in dispute resolution proceedings before a consumer arbitration board. Legal rights remain unaffected.

16. Force Majeure

Events outside our control (e.g., natural disasters, strikes, government measures, telecommunications failures, pandemics) may delay the fulfillment of the contract. In such cases, deadlines will be extended appropriately; further legal rights remain unaffected.

17. Applicable Law and Jurisdiction

The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods (CISG). For consumers, mandatory consumer protection regulations of the country where they have their habitual residence apply. If the customer is a merchant, the exclusive place of jurisdiction is the seat of Clube Boss; however, we are entitled to sue at the customer’s general place of jurisdiction.

18. Changes to the T&Cs

We reserve the right to adjust these T&Cs if necessary to eliminate subsequent disruptions of balance or to adapt to changed legal frameworks. We will inform you of significant changes in a timely manner. For contracts already concluded, the T&Cs applicable at the time the contract was made shall apply.
